The Senate Health and Welfare Committee voted to reject a subsection of the National Society of Genetic Counselors (NSGC) Code of Ethics that had been incorporated by reference into an administrative rule (IDAPA 24.24.01.002).
Senator Bierke moved to approve pending docket number 24-2401-2401 and the motion carried by voice vote. The committee then considered a motion, made by Senator Bierke and seconded by Senator Blaylock, to reject a subsection of the NSGC Code of Ethics (identified in the final rule as an incorporated reference). The committee debated whether specific nondiscrimination language in that incorporated code should remain; Senator Bierke characterized the language as a list of protected identities included in the incorporated ethics code. Committee members said the portion being struck listed a "long list" of identities under nondiscrimination standards. A committee member reported that representatives (from the implementing department) had told the committee that striking the provision would not change how the profession is regulated in practice.
