The Idaho Senate Health and Welfare Committee on Thursday voted to send RS32137 to print. The draft statutory language would move a longstanding administrative-rule provision related to child support enforcement and license suspensions into statute and remove Temporary Assistance for Needy Families as a listed good-cause exemption.
Senator Brandon Shippey presented RS32137, explaining the proposal would move “section 302 from IDAPA 16.03.03, child support services, from administrative rule into statute.” He said the proposal returns the rule to the Legislature and preserves the existing rule language in statute, with “one slight change”: it eliminates TANF as an allowed good-cause exemption for avoiding suspension of a driver’s or occupational license for nonpayment of child support.
Why it matters: The change would take a provision currently in administrative code and place it in statute, shifting responsibility for the specific good-cause exemptions from the department rulemaking process to the Legislature. Removing TANF as a listed good-cause exemption would narrow the categories of recipients who could claim that exemption according to the draft language presented in committee.
Committee action Senator Shippey presented the RS and answered procedural questions. Senator Wintrow asked whether the rules being moved were those the committee had already reviewed; Senator Shippey said they had been reviewed and that the department worked with him on the draft. He declined to discuss the rationale for removing TANF from the exemption list in detail in committee, saying he would reserve that explanation for the full hearing.
The committee then approved a motion to send RS32137 to print. The motion to send the RS to print was made and seconded; the committee recorded an affirmative voice vote.
Limitations and next steps Senator Shippey said the only substantive change from the administrative rule language is removal of TANF from the exemption list. He told the committee he would provide fuller explanation and supporting evidence at a subsequent full hearing. The RS has been ordered printed and will be scheduled for a public hearing where the details and policy implications can be examined and debated.
