Sen. Dan Foreman presented RS31878, which he described to the committee as the "Idaho Bill of Patient Medical Rights," a proposed addition to Chapter 90 of Idaho Code intended to codify patient rights on informed consent and limitations on denying care for refusing vaccines.
"This legislation establishes some seminal patient rights including a patient cannot be denied treatment for refusing a vaccine, a patient has a right to informed consent with respect to medications and medical treatments," Foreman told the committee. He also said the bill would bar administering experimental drugs without written informed consent.
Foreman said the measure would "directly support" Idaho Code §39‑9003, the Idaho Health Freedom Act, and that the attorney general’s office reviewed the draft and found no conflict with the state or U.S. constitutions as presented. He also referenced Idaho Code §67‑1405 as the statutory provision authorizing the attorney general to seek injunctive relief against violators.
During questions, Sen. Wintrow noted she had supported an earlier bill because its nondiscrimination clause explicitly included age, sexual orientation and gender identity and asked whether those categories would be re‑inserted; Foreman said he would not add those categories back in.
Sen. Lenny moved to send RS31878 to print; Sen. Zieterfeld seconded. The committee approved the motion on a voice vote. The transcript records no amendments or additional committee instruction at that time.
