Committee approves moving mental-health and substance-use rules into Idaho code

The Senate Health and Welfare Committee voted to send Senate Bill 1024 to the Senate floor with a due-pass recommendation. The bill transfers parts of recently approved administrative rules for children's mental-health services, adult mental-health services and substance use disorder services into Idaho code.
Senator Julie VanOrden, sponsor of SB1024, told the committee the measure does not change services or eligibility but moves definitions, eligibility and screening requirements and certification standards from IDAPA rule into corresponding chapters of Idaho code. "Nothing has been — there's not an increase or decreased services to anyone. It's just taking that part of administrative rule and applying it to the code," VanOrden said. She said the bill also repeals the corresponding rules effective the same day the code changes take effect.
VanOrden said the change will allow the Legislature to have clearer oversight and make future changes through statute rather than the rule-making process. Committee members asked questions; no public testimony opposed the bill during the hearing. Senator Blaylock moved the measure and Senator Delaney seconded; the committee advanced the bill by voice vote. The measure proceeds to the full Senate for further consideration.
