McCurdy explained that incorporation by reference maintains DEQ primacy so Idaho implements EPA hazardous‑waste rules; compliance with federal regulations is required whether or not states incorporate them, but incorporation provides a single set of enforceable rules for regulated facilities. He said the Board of Environmental Quality adopted the rule on Nov. 14, 2024, there were no written comments to the notice and that the docket includes an update to EPA Method 23 for analytical methods.
Senator Harris moved approval and Senator Blaylock seconded. The committee voted to approve the docket on a voice vote.
