Genetic counselor licensing rewrite held for one week after committee questions

The House Health and Welfare Committee voted to hold for one week (returning Jan. 29) the rewrite of the Idaho Genetic Counselors Licensing Board rules (Docket 24-2401-2401) after committee members raised a question about incorporation by reference and investigatory procedures.
Cecily Metcalfe, executive officer for the Genetic Counselors Licensing Board and the division’s Board Services Program Manager, presented the rewrite as a 0-based regulation that deleted redundant language, moved consolidated licensing provisions into a single section and removed continuing-education requirements where national board certification already requires continuing education. "A clean version of the rules has been provided and a crosswalk is available," Metcalfe said.
Committee members asked about authority to create an inactive license status and how criminal-history review would be handled. Metcalfe said legal review determined no statutory authority existed for inactive status and that the statute and board processes permit consideration of criminal history under Idaho code 67-94-11. The presenter also provided the board’s cash-balance figure: "The cash balance for this board as of September 30 was $143,548.51," Metcalfe said.
Representative Rasor raised a concern about incorporation of the National Society of Genetic Counselors (NSGC) code and whether that incorporation could affect how the board conducts inquiries; Representative Rasor said she was awaiting a response from legal counsel. With that outstanding question, Representative Rasor moved (and the committee adopted) a motion to hold the docket for one week.
Metcalfe had recommended approval of the pending rules as final, noting removal of duplicative provisions and consolidation of licensure language. The committee will revisit the docket at the date set by the chair and expects a legal response on the incorporation-by-reference question before deciding whether to adopt the rules.
