Boyle told the committee the rewrite reflects roughly four years of work among stakeholders and that the Idaho Transportation Department already "has funds existing to develop this portal," so she said the rewrite "isn't gonna cost the taxpayers any money." She walked members through the bill text, noting requested drafting corrections: removing the words "or any affiliate of a law enforcement agency" (page 2, lines 12'13) because no definition existed for that phrase, and adding wording on page 8, line 42 (after the word "attorney") to require access "during reasonable business hours at no additional charge."
The rewrite covers procedures for handling stolen vehicles and abandoned vehicles, the 48'hour preliminary hold and notification steps for law enforcement, registered-letter notification when owners are not reached, processes for removing vehicles from private land, responsibilities of law enforcement, towing companies and ITD, hearings and fee dispute processes, vehicle-release conditions, required rate sheets and a 60'day maximum storage period, and establishment of trust accounts for certain fees. Boyle noted the draft also standardizes statewide procedures so "no local government can make other kinds of rules or ordinances to change this."
Representative Palmer moved to introduce RS 32197 with the two sponsor changes Boyle requested (remove the affiliate phrase on page 2; add the attorney-access wording on page 8). Representative Clow asked what prompted a complete rewrite; Boyle said the prior statute had become "unworkable" and caused repeated difficulties among ITD, towing companies, and law enforcement. Representative Shepherd asked specifically about the removed "affiliate of law enforcement" language; Boyle said it was a drafting leftover with no clear definition and therefore should be removed.
The committee voted to introduce RS 32197 with the sponsor's changes by voice vote; the chair recorded "aye" responses and stated "motion carries." The transcript does not show a roll-call tally. The bill will proceed to a formal hearing where stakeholders can submit testimony and suggested amendments.
