Panel approves technical amendment to align conjunctive-management rule with 2024 statute

The Idaho Senate Resources and Environment Committee approved an amendment to the state's conjunctive-management rules to align rule language with a statute enacted in 2024.
Eric Boe, Water Compliance Bureau Chief and rules review officer for the Department of Water Resources, presented the pending amendment (docket 3703112401) to Rule 50 of IDAPA 37.03.11, stating the department initiated the change specifically to align the rule with Section 42-233C of Idaho Code. Boe said Section 42-233C, effective July 1, 2024, clarifies the area having a common surface and ground-water supply for the Eastern Snake Plain aquifer and the amendment ensures continuity between statute and administrative rule.
No members of the public testified on the docket. Sen. Harris moved to approve the docket; Sen. Cook seconded. The committee approved the amendment by voice vote.
Boe said the department published the proposed amendment Oct. 2, 2024, and published the pending amendment Dec. 4, 2024, without changes.
