The House State Affairs Committee voted to send House Bill 276 to the House floor with a due-pass recommendation after Representative Vito Barbieri introduced the measure to equalize treatment of small out-of-state brewers.
Barbieri said litigation from out-of-state brewers alleging unequal treatment prompted the bill. The measure would treat brewers producing under 30,000 barrels the same as in-state breweries if they maintain a warehouse or brewery physically located in Idaho and distribute only their own products using brewery employees and equipment.
Barbieri told the committee the physical-presence requirement creates unquestioned jurisdiction for regulators, enables inspections and provides accountability to state enforcement agencies including the Idaho State Police Division of Alcohol Beverage Control, the Idaho State Tax Commission and the Department of Health and Welfare.
Representative Akiles moved to send the bill to the floor with a due-pass recommendation; the committee voice-voted the motion carried. No public testimony was recorded in the transcript and one audience member indicated he had intended to testify but declined.
If advanced by the House, the bill would proceed to committee hearings and possible amendments; Barbieri framed the bill as intended to create regulatory clarity and parity for small brewers operating in or entering Idaho.
