Representative Lucas Kaler (District 11) presented House Bill 336 to the House Health and Welfare Committee, describing it as a transfer of IDAPA child support rules into statute without creation of new laws.
Kaler said the bill moves IDAPA rules 16.03 0.03 related to child support services into statute and highlighted enforcement provisions: it "will allow the Department to intercept and retain child support from an obligor parent to assist with foster care and foster care placement," and it permits the Department to notify consumer reporting agencies of overdue support that exceeds $2,000 and is three months in arrears. Kaler also listed judicial procedures for income withholding, enforcement of medical support and authority for the Department to enforce child support.
A committee member asked about fees on page 2, noting amounts of $25, $35 and $550 and whether those amounts were flat or maximums. Kaler said those were existing fees in rule that were moved into statute, and that section 7 allows the Department to charge fees to compensate it for services rendered or enforcement of support obligations.
Representative Wheeler moved that the committee send House Bill 336 to the floor with a due‑pass recommendation. The motion carried by voice vote and the bill was reported to the floor.
