Board Orders Repair of Missing Pool Screening at Seminole Lakes Boulevard Property within 15 Days

The Punta Gorda Code Enforcement Board on Oct. 21, 2025, found that the property at 26072 Seminole Lakes Boulevard was in violation of Punta Gorda Code for missing screening on a pool cage and for a public-safety public-nuisance concern, and ordered the respondents to correct the condition within 15 days.
Meredith Achtenberg, co-compliance officer, presented photographs and said her Aug. 4, 2025 inspection showed areas of missing screening on the pool enclosure, which she described as a danger to public safety and welfare and cited Punta Gorda Code chapter 26 section 8.11(b) and chapter 9 section 9-2(g). The notice of violation and order for corrective action was posted and mailed, but certified letters were returned undelivered. Achtenberg said re-inspections on Sept. 9 and Oct. 20, 2025, found the missing screening remained; staff submitted case costs of $28.72.
Board members discussed whether the city could take interim steps to protect the public. Rachel Berry, Zoning Official, and Public Works staff told the board neighbors and passersby had accessed the site when gates were left open; staff proposed that if the respondents did not comply within the deadline, the city would seek City Council authorization to install a temporary safety barrier and recover the costs as a lien on the property.
The board voted to find a prima facie case and then to issue a cease-and-desist order, require correction within 15 days of receipt of the order, require payment of $28.72 in case costs within 30 days, and direct staff to seek City Council authorization to install a temporary safety barrier if the respondents fail to comply. The board also noted the authority under Florida Statutes chapter 162 for enforcement and subsequent remedies.
