Planning commission recommends approval of Legacy Grove Section 1 final plat

The Montgomery Planning and Zoning Commission on Sept. 2 recommended approval of the final plat for Legacy Grove Section 1 (Development 2409). The recommendation will move to city council for final action; staff said the developer must submit impact fees, plat fees and a financial guarantee for construction before council consideration.

City staff outlined the plat details: lots in the section are proposed as roughly one‑third‑acre blocks, street cross sections include a 60‑foot right of way and a 28‑foot pavement width in the cited section, and the developer will extend public water and sanitary infrastructure. Staff said sanitary relocation and water design work are in progress and that the project requires approvals from the Texas Commission on Environmental Quality (TCEQ) for sanitary design.

Commissioners asked about tree protection. One commissioner asked staff and council to reopen or provide additional guidance on Chapter 78 (the city’s subdivision/tree ordinance) because some trees on the property are mature and staff should study which trees to save versus remove. Staff responded that the final plat review includes landscaping and tree‑reserve requirements and that the developer had identified areas for tree reserves in the plan filed with council.

Action: A motion to approve the final plat for Legacy Grove Section 1 (Development 2409) was made and seconded; the commission voted in favor and the motion passed. Staff said site clearing and utility work will follow required permitting and design approvals.

Staff also said clearing had not yet begun for water, sanitary and drainage construction, though tree clearing for grading may start in advance of utility installation; staff estimated those construction steps would commence in the coming weeks to months after permit approvals.
