Sen. Foreman’s proposal would bar colleges from limiting concealed carry; committee sends bill text to print

Sen. Dan Foreman (R-District 6) introduced RS31839 on Jan. 17, a proposed bill that would repeal Idaho Code section 18-3-309 and replace it with a provision prohibiting colleges and universities from limiting possession, carrying or transportation of firearms or ammunition by individuals holding a lawful concealed weapon permit.

Foreman told the Senate State Affairs Committee that many constituents view current campus restrictions as an infringement on Second Amendment rights and noted existing institutional exceptions allowing authorized employees to carry. He said the proposed change would remove colleges’ authority to restrict otherwise lawful concealed carry on campus and argued that constitutional rights should not be administratively limited.

Senators asked procedural and policy questions during discussion. Senator Bert Berndt raised concerns about large venues such as stadiums on campus; Foreman said the proposal would remove those restrictions and stressed faith in Idaho citizens’ law-abiding behavior. The committee voted to send RS31839 to print.

The proposal, as presented in committee, does not include a fiscal note beyond standard printing costs and would change statutory authority granted to multiple higher-education governing boards if enacted.
