The Nash County Board of Commissioners voted 4–3 on Oct. 6 to deny conditional rezoning request CZ-2500901, a proposal to rezone about 151.6 acres on Wildlife Road to allow a 122-lot single-family subdivision.
The proposal, submitted by Little Bear Creek Properties and presented by Planning Director Adam Tyson and engineer Justin Brown, would have reduced minimum lot sizes from 40,000 to 30,000 square feet, required extension of Nash County public water to the site and placed roughly 28 acres into a permanent conservation easement. Tyson told the board the developer revised the plan after a June denial to add public water service, a permanent conservation area and perimeter screening buffers.
Why it mattered: Neighbors said the development would add concentrated septic systems and heavy traffic to a dead-end rural road and would change the area’s character. A long public hearing drew multiple residents from the Castellia/Red Bud Road area who cited safety, flooding, wildlife and infrastructure concerns. Several speakers urged larger lots, better traffic planning or denial.
What residents said: Bruce Everett, a Wildlife Road resident who circulated a petition opposing the plan, told commissioners that residents “feel like they have no say” and called the subdivisions “like a cancer” scarring rural areas. Richard Huggins said the plan “wasn't appropriate for the area” and predicted traffic backups on Wildlife Road. Adjacent landowner Randy Mays said the development would leave new residents remote from groceries and services and predicted noise and safety issues.
Developer response and staff analysis: Justin Brown, engineer for Pennoni Associates representing the applicant, presented a comparative analysis showing the RA-30 conditional-plan would yield only about 12 more lots than an R‑40 by‑right layout, would reduce total road linear footage and preserve more open space through the proposed conservation easement. He said the developer planned three stormwater control ponds and engaged a soils firm for septic siting; he told the board the planned community water extension would be engineered and paid for by the developer.
Board debate and vote: Several commissioners raised emergency-access concerns for a long, dead-end road and questions about whether a single entrance would be adequate — an issue that may become subject to a 2026 fire-code change. Commissioners also weighed the tradeoffs of accepting an RA‑30 conditional zone that would require the developer to extend water, install screening and dedicate conservation acreage versus allowing an R‑40 by‑right development that would require fewer conditions. After discussion, a motion to approve the conditional rezoning was moved by Commissioner Wilkins and seconded; the motion failed on a 4–3 vote.
Outcome and next steps: With the conditional rezoning denied, the applicant retains whatever rights the current R‑40 zoning permits (including a by‑right development option). The Planning Department and the applicant were present and said they would remain available for follow-up; several residents asked the county to continue studying water, septic, traffic and emergency-access issues for the corridor.
