Commissioners approve one-acre subdivision variance for Brooks property; one abstention recorded

Mills County Commissioners Court voted to approve a subdivision variance on Oct. 13 permitting the sale of a one-acre parcel from Keith and Brenda Brooks adjacent to land owned by Tim Spradley.
Former County Attorney Gerald Hill explained the request: the Brookses wish to sell a one-acre parcel that includes an existing well and sole access from Texas Highway 16. Hill told the court the parcel does not meet an exemption under the county’s subdivision regulations and therefore required a variance. He said the Brookses indicated they had no intention of further subdividing the remainder of their property.
The County Judge moved to approve the subdivision variance; Commissioner Hett seconded. The motion passed with four votes in favor and one abstention. The court recorded the abstention as stemming from a relative involvement tied to Commissioner Williams; the court did not detail further recusals.
Why it matters: The variance clears the way for the Brookses to complete the one-time sale and for the purchaser to take title with retained driveway access from Highway 16 and a well on the parcel. The court’s recorded abstention reflects a conflict principle applied in that vote.
The county clerk confirmed the required $200 fee for the variance application had been paid.
