Summary
After testimony from an officer and several family members, the court found probable cause on assault and child-endangerment allegations and set bond at $50,000 with GPS monitoring and a no-contact order for defendant Ethan Beard.
Judge David D. Wolfe set bond at $50,000 on a charge package that includes aggravated assault and child endangerment for defendant Ethan Beard, and ordered GPS monitoring and a no-contact order after testimony from Waverly police and multiple family witnesses.
The judge made the ruling after the state called Officer Corey Field of the Waverly Police Department, who described responding to a January 2025 report, forcing entry into a home where two young children were present and observing children with soiled diapers and visible bruising. Officer Field testified that he found a crib or baby gate barricading a door, that a child was yelling inside the residence, and that Beard was located sitting on a bedroom bed with two children near him; the officer said he gave verbal commands and later took Beard into custody without incident.
Caitlin Miller, identified in court as the mother of the children and the alleged victim, testified about multiple incidents she said occurred in October–December 2024, including being grabbed by the throat and other physical assaults; she said she provided time-stamped photographs of bruises to investigators. The state introduced testimony and a video excerpt of the arrest; Officer Field said the body-worn camera and photos corroborated the scene, although some original body-cam footage later was unavailable.
Family members called by the defense, including Candy Beard (the defendant's mother), Erica Carter (sister), Britney Frederick (former partner), and Marshall Allen Beard (aunt), testified about the defendant's character, his ties to Humphreys County and relationships with children, and disputed that he was prone to violence. The defense argued those character witnesses, together with history and lack of certain convictions, supported a lower bond or electronic monitoring rather than continued pretrial incarceration.
The court weighed statutory bond factors including residence in the community, employment history, ties to family, the nature of the offenses and the apparent probability of conviction. Judge Wolfe said he found the victim's and officer's testimony credible and that the totality of evidence supported higher conditions. The judge ordered that if Beard made bond he must pay for and wear GPS monitoring at his expense, have no direct or indirect contact with Caitlin Miller, and that any visitation or contact with the children may occur only by order of the juvenile/domestic relations court. The judge also directed that victim-notification and monitoring arrangements be available.
Defense counsel indicated plans to file motions and pursue further hearings; the court set a future status and motion date tied to calendar scheduling.
The order and the judge's findings were entered on the record at the hearing.
