Lucy Barr, who presented the request, said the house was built before the Unified Development Code (UDC) and currently sits about 6.76 feet from the rear property line; the UDC’s downtown development regulations permit matching adjacent front and side setbacks to neighboring structures but do not extend the same exception to rear yards. The proposed addition would align with the house’s existing rear wall.
The owner attended the hearing and voiced support; no members of the public registered opposition. A board member moved to approve the variance, a second was given, the board voted aye and the motion carried.
Staff confirmed the variance was necessary because the UDC does not allow the same rear‑yard exception that it allows for front and side yards adjacent to existing structures. The commission closed the public hearing and approved the variance as presented.
