On Oct. 7 the Eagan City Council enacted an ordinance amendment to City Code section 6.56 that removes the zoning‑based allocation of adult‑use retail cannabis registrations between commercial and industrial districts while leaving the overall registration cap in place.
City staff explained the prior code limited the city to no more than eight retail registrations, allocated as five in commercial zones and three in industrial zones. The amendment retains the overall cap of eight local retail registrations but eliminates the sub‑allocation so that eligible applicants may be located in either type of zoning subject to other code standards. Staff noted that medical combination businesses (for example, licensed RISE dispensaries) are not counted against the local retail cap under state rules and remain excluded from the eight‑registration limit.
Council members asked about spacing and other technical elements; City Planner Schultz said spacing issues could be addressed separately and staff hoped to provide an update in the following weeks. Councilmember Hansen had earlier thought the city might need to raise the cap to nine, but staff clarified the existing cap remains appropriate because combination medical licenses are excluded from the local retail count.
The council adopted the amendment by voice vote as presented.
