Milwaukee committee denies most damage claims, approves $4,000 settlement in sinkhole case

The Judiciary and Legislation Committee of the Milwaukee Common Council on Oct. 6 recommended denial of numerous citizen claims against the city and approved a $4,000 settlement in one claim arising from a vehicle sinking into a road excavation.

The committee voted to deny a string of claims — many for nonappearance — and to refer those denials to the full Common Council for final action on Oct. 14, 2025. Committee members repeatedly told claimants that a denial from the council is a statutory prerequisite to taking a claim to circuit court.

Why it matters: These committee decisions are the formal gate for municipal liability claims. A referral of denial gives claimants the notice needed to pursue litigation; approving a settlement ends the matter administratively.

What happened (most notable items) - Multiple claims denied for nonappearance or on the merits. The committee moved for denial, and, in each case where no committee member objected, the denial was ordered and will go to the full council. Those items included claims identified in the meeting by docket numbers and claimant names such as James Trefry (item 231325), Katrina Turner (item 240243), Chrissy Harrell (item 240386), Javier Inca (item 5230871), Catherine Swarovski (item 6230904), Warren Hair (item 8240068), and others. In several matters staff recommended denial after investigation and committee members moved to deny for nonappearance.

- Denials on evidence or timeliness. The committee recommended denial for a claim alleging a collapsed sewer lateral at 3350 N. Kramer St. (claimant: Miss Kirk). City staff told the committee the claim was untimely under Wisconsin’s 120‑day claim period and that sewer records showed no city facility failure; the city attorney's office recommended denial. Committee members emphasized the 120‑day filing rule and voted to deny.

- Forestry/tree claims. Several claims alleging damage from falling trees or branches were denied after the Forestry Division and the city attorney’s office reported that crews found the failed limbs were alive or the decay was not visible and that weather conditions (storms) explained the failures. Claimants in those matters included Imari Dutch and Linden Reed; staff said forestry crews responded, removed branches, inspected trees and found no observable negligence.

- Drain/sewer claims. In multiple lateral/backflow claims, sewer staff and Water Works representatives told the committee the city main was operating normally and that laterals are the property owner’s responsibility. The committee followed staff recommendations to deny some of those claims.

- Approved settlement: $4,000. In the most significant financial outcome, the committee recommended a $4,000 settlement to resolve the claim by Charles Wetherbee Jr. (Weatherby) arising from an incident in which he drove into a sinkhole at a repair site. Committee members described factual conflicts among witness statements (claimant and Water Works/public‑works crews) and offered the payment as a pragmatic resolution; the motion for a $4,000 settlement carried with no objections and will be presented to the full council for final approval.

- Payments/insurance matters. The committee also approved routine resolutions authorizing payments on underinsured/uninsured motorist claims handled by outside counsel (examples in the file were Christopher Burch and David Nimi), and approved continuation of outside counsel funding in a long‑running litigation matter (Harris case) where federal claims were dismissed and state claims remain.

How the committee acted procedurally Chair Alderman Deandre Jackson called each docketed item; motions to deny were typically made from the dais (Aldermen Mark Chambers and Bob Baumann were frequent movers) and carried “hearing no objection.” Where claimants appeared, committee members asked for clarification of timing, insurance filings, or evidentiary proof; staff from the City Attorney’s Office, Milwaukee Water Works, Sewer Services and Urban Forestry responded with investigative findings.
