Planning Board recommends rezoning of 0 Brunswick Road to allow single-family home

The Village of Depew Planning Board voted 5-0 on Oct. 2 to recommend that the Village Board rezone a vacant parcel at 0 Brunswick Road (SBL 115.06-3-8.1) from C-2 Shopping Center District to R-2 Residential District to allow construction of a single-family home.
Jason Burford, representing Greenman Peterson, Inc. and the applicant Legacy Lane Properties, told the board the parcel is "roughly a half acre" and is currently zoned C-2 but is adjacent to R-2 and located in a residential neighborhood. "We're seeking the review and approval of a rezone for what's identified as 0 Brunswick," Burford said.
Sam (Village attorney) noted the project had appeared before the board previously and had received prior approval, which the board said had answered earlier questions. Code enforcement and engineering staff gave no objections on the record. There were no public comments recorded on the item.
Member Soja moved and Member Fedorowicz seconded a motion "to make a recommendation to the Village Board to accept the rezone, as submitted." A roll-call vote recorded five yes votes from Member Soja, Member Fedorowicz, Member Matuszak, Member Spencer and Chairman Maciejewski; the motion carried.
The recommendation is advisory to the Village Board; the transcript and motion reflect that final rezoning requires Village Board action.
The board did not adopt a development plan or issue building permits at this meeting; the discussion and vote were limited to the planning board's recommendation to the Village Board.
