Troy Zoning Board OKs 91-foot area variance for 1819 Fifth Avenue

The Troy Zoning Board of Appeals on Oct. 1 approved an area variance for 1819 Fifth Avenue that would allow a driveway and accessory building to remain about 100 feet from the street where the local code requires a 10-foot setback.
Lindsay Hooper, speaking on behalf of 1819 Fifth Avenue Associates LLC, told the board the application seeks “about a 91 foot variance” because the existing garage and driveway place the accessory structure far behind the main building. Hooper said the property owner had first presented the matter at an earlier meeting and was returning to seek relief from the setback requirement.
The board conducted environmental review and then moved to approve the variance. A board member moved that the variance “would not create an undesirable change in the character of the neighborhood” because the parcel is being subdivided and both structures are preexisting; another member seconded the motion. The motion passed by the board’s vote and the variance was approved.
Hooper confirmed the subdivision and any subsequent lot-line or subdivision approval will proceed through the planning board as required by city procedures. The variance covers the setback relief only; subsequent steps for subdivision or separate deeds were discussed as follow-up actions by the applicant.
The board recorded the approval and the applicant departed after the vote.
Less-critical details: the application description notes the existing structure sits roughly 100 feet back from the street and the relief requested was approximately 91 feet. The matter had been discussed at a prior meeting and was returned for a decision after the applicant elected not to hold the application in abeyance because a quorum was present.
