Shady Oaks owners request continuance after as-built shows mobile home placed on cemetery lot line

Leah and James LLC requested a continuance for a variance application related to Home Number 22 in the Shady Oaks Mobile Home Park at 103 Newbury Street (docket 25-5119) after an as-built survey showed the unit sitting on the cemetery lot line.
Attorney Nancy McCann told the board the park previously received approvals in 2023 to add homes and that "Home Number 22 did receive variance relief to be 10 feet from the, side lot line." During construction the home was shifted and "the as-built survey, unfortunately identified Home Number 22 as, being on the lot line with the, what is an ancient, cemetery." Project engineer Will Schkuda explained the unit "was shifted back, which actually improves the drive aisle" and noted the move improved sight lines and snow-plowing operations on a challenging lot.
Board members asked background questions about unit sizes, the presence of propane tanks and existing neighboring homes that are already close to the cemetery line (one at 1 foot, one at 2 feet). Owner James St. Pierre confirmed the park maintains the cemetery parcel and that the feature is effectively an "orphaned parcel" with no known owner; the park has been maintaining it.
Rather than decide final zoning relief at this meeting, the applicant asked for, and the board granted, a continuance to the board's November 10 meeting to allow the owner time to evaluate options. The board recorded the continuance on a voice vote.
