Board approves variance for 4206 Devine Street after builder cites subcontractor error

The Columbia City Board of Zoning Appeals approved a variance to the side-yard setback for a new single-family residence at 4206 Devine Street after the applicant told the board a subcontractor’s error shifted the house into the required setback.
Steve Applewhite of Keystone Custom Builders told the board, “I purchased this property earlier this year at 4206 Devine Street.” He said he began construction using mirrored plans for adjacent lots, halted work after noticing a discrepancy, and that a later survey showed the house had been placed inside the side-yard setback because his subcontractor “made a mistake.” Applewhite said he explored moving the property line but was told that option was not possible and that he was seeking a variance to avoid demolishing the existing work or pursuing litigation with the subcontractor.
According to Applewhite, the required side-yard setback was 8 feet and the house is inside that line by about 4.2 feet; he requested a variance of 4.2 feet. No members of the public registered opposition during the hearing.
A board member moved to approve the variance request “subject to staff comments,” another board member seconded, and the motion passed with unanimous “aye” votes. The board did not record any amendments to the motion. The vote was followed by the board moving on to adjourn the meeting.
