Brookings planning commission approves minor partition at 940 Weaver Lane

The City of Brookings Planning Commission on July 15, 2025, approved file M3-2-25, a request to partition a 1.87-acre parcel at 940 Weaver Lane into two parcels, based on findings in the staff report and subject to conditions of approval.
City planning staff told commissioners the site is zoned R-1-6 and that each proposed parcel exceeds the 6,000-square-foot minimum lot size. The staff report, which cites Chapter 17.172 (land divisions), Section 17.128.005 (access), Chapter 17.168 (public facility improvement standards) and Chapter 17.2 (single-family residential R-1-6), recommends approval with conditions including dedication of a 50-foot right-of-way and 5-foot public utility easements on each side of that right-of-way.
Tony, planning staff, said the 50-foot right-of-way "is actually gonna be dedicated immediately as a private road," and will be platted as private until future partitioning requires it to be engineered and dedicated to the city as a public street. Staff also explained that deferred improvement agreements (DIAs) will be recorded and remain on title; those DIAs will be "called in" and triggering street improvements when further subdivision of either new parcel occurs.
According to the staff presentation, Parcel 1 is undeveloped; Parcel 2 contains a 1,096-square-foot dwelling scheduled for demolition. A shadow plat accompanying the application shows the site could accommodate up to nine lots in a future, larger partition. Weaver Lane is currently an unimproved 50-foot gravel travel surface accessed from Hassett Street and provides access to about 12 parcels, 10 of which are developed with single-family dwellings.
Several residents spoke during public testimony raising objections about cost, traffic and drainage. One resident said the proposal "is just gonna chop up this to nothing," and questioned an estimated $650,000 cost referenced for improvements. Residents also raised concerns about groundwater and runoff, saying the area contains the headwaters of a local creek and expressing worry about flooding and drainage impacts if the upper parcel is developed.
Planning staff and an applicant representative responded that an engineering design for improvement of the affected section of Weaver Lane is shovel-ready and that funding choices — including calling DIAs, forming a local improvement district or using a mix of general fund and DIAs — would be decisions for the city council when the work is triggered. Staff reiterated that until the road is formally dedicated, the city accepts no responsibility for maintenance.
A motion to approve file M3-2-25 passed on a voice vote. Commissioners recorded "aye" for Chair Watwood, Commissioner Chapman, Commissioner Volkowitz, Commissioner Bond and Commissioner Whitmore; a subsequent approval of the final order recorded an "aye" from Commissioner Wilkiewicz as well. The commission also approved the July 1, 2025, meeting minutes during the same session.
The commission’s decision approves the partition and its conditions; further development that would require street improvements will trigger the recorded DIAs and additional review. Residents were advised they may address the city council about funding or DIA release at a future council meeting.
