Residents tell Rowlett council about access-easement retaining wall and privacy concerns at new complex

Two members of the public addressed the council during the citizens input portion of the Sept. 30 meeting.
Dave Hall, who identified himself by address, told the council a retaining wall was built within an access easement serving his properties at 6809 and 6811 (address style in transcript). Hall said city research on the easement had been inaccurate and that county records and a sealed survey show the parcel contains an ingress and egress easement in addition to a utility easement. “The warranty deed registered in Dallas County ... clearly states ingress and egress easement,” Hall said. He requested the council and staff review the city’s permitting and inspection related to the retaining wall and indicated he would provide exhibits he referenced at the meeting.
Jared Herron said he and his husband live at 3409 Summer Solstice and also own property at 3609 Daniels Street. Herron said a multiunit project on Main Street (the speaker referenced a development commonly called “The Oasis”) was approved as condominiums but appears to be leased as apartments. “We have absolutely no privacy in our backyard,” Herron said, adding that second- and third-floor units have direct sight lines into his yard. He asked whether the city’s Planning and Zoning process can include contract stipulations preventing developers from converting for-sale condos into rental apartments; staff replied that whether units are sold or rented is not a land-use consideration codified in city ordinance or state law.
No council action was taken during citizens input; both matters were presented for council and staff awareness and possible follow-up by the appropriate departments.
