After a public hearing, the City Council approved rezoning 1245 East South Boulevard from O-1 (office) to B-2 Q (general commercial with a use restriction). The applicant, Darrie West, told the council he purchased the building in May and intends to operate a business there; the planning commission had recommended B-2 Q with a restriction for a child-care center. Council members then amended the ordinance to explicitly allow both child care and elderly-care facilities; the amendment passed and the ordinance was adopted unanimously.
Why it matters: Rezoning changes the range of uses allowed on the site. Council and planning staff noted that opening the parcel to a full B-2 classification without a Q would permit uses such as gas stations, motels and other general commercial uses; the Q limits those possibilities to the uses the council approves.
Details from the hearing Applicant Darrie West said he purchased the building with the idea of opening a daycare and that playground space may limit the number of enrolled children. Planning staff confirmed the planning commission recommended the B-2 Q zoning to restrict uses consistent with the applicant’s stated intent. Council members asked whether the applicant would need to return to the planning commission if the Q were lifted; staff said the council has final authority but lifting a Q could permit additional commercial uses that may be undesirable for nearby neighbors.
Council action Councilors first voted to amend the ordinance to add elderly-care use along with child care, then voted to adopt the ordinance as amended. The clerk recorded the vote as unanimous.
Ending The rezoning was adopted as amended. Council members and neighborhood advocates said the change supports the applicant’s plan while protecting nearby residents from incompatible commercial uses.
