The City Council opened a public hearing on Annexation 0325 (Stoney Creek) and, after no one spoke, voted to continue the matter to the first council meeting in November so staff can resolve a deeded railroad right‑of‑way issue.
Planning staff told council the parcel is city‑owned land adjacent to Stoney Creek on the south side of Royal Avenue. During processing, staff discovered a deeded railroad right‑of‑way over part of the property and said the railroad has forwarded the matter to its legal counsel. Because the right‑of‑way is deeded property rather than a DOT‑owned easement, the railroad’s signature will be required on the annexation application.
Planning staff recommended either continuing the hearing until the railroad’s right‑of‑way counsel signs or withdrawing and resubmitting the application once the deeded right‑of‑way signature is obtained. Councilmember Lawrence asked staff to set a date certain; the council amended the motion to continue the public hearing to the first meeting in November and approved it unanimously.
Staff will follow up with the railroad’s legal division and bring the case back to council when the required signatures are in hand.
