Public commenters and one commissioner raised concerns that a recent special meeting had been videoed but not uploaded to the city’s communications page, and said that failure may violate the state open-meetings statute’s recording requirements.
A commissioner moved that earlier comments regarding the missing posting stand as the commission’s position; after brief legal input, the motion was adopted on a 3–2 vote. City legal counsel noted the recording rules that took effect in July 2025: meetings held in the Commissioners Conference Room must be recorded and posted, while public meetings held in rooms other than that chamber need not be recorded unless they are council meetings.
Separately during public comment, speakers asked whether taxpayers remain responsible for maintenance payments on the downtown parking garage tied to the Promenade and whether the public can use that garage. Commissioners and staff said the city continues to participate in maintenance and operations of that garage at an amount stated in the meeting as $3,333.33 per month for 10 years (approximately $400,000 overall), and that a 2% annual fee applied in the contract raised the cumulative obligation toward $437,000 (transcribed figures). Commissioners said the facility remains reserved for Promenade residents and not open to general public parking unless they are residents there.
Commissioners and staff agreed to endeavor to publish meeting videos to the city communications page when recordings are available and to be transparent about where meetings are posted. A city official also clarified that the special meeting in question was not recorded by the city and that Ball State reporters had recorded aspects of it; no city-owned recording exists for that meeting.
