Planning staff presented a French Forest plat that contains an unusual front-setback situation: because a portion of a parcel’s front boundary is the state right-of-way center line, the measured front setback can differ depending on whether it is calculated from the property line or the edge of pavement.
Staff asked the commission for guidance on interpreting the 75-foot front setback for an A-1 agricultural lot where the state has taken part of the roadside right-of-way. Staff said in many county cases the front setback is measured from the edge of pavement when the property line coincides with the road centerline. The commission indicated it had no objection to that interpretation and staff said it did not expect a variance would be necessary; if one were required the board of adjustment review would be used.
Staff also noted the plat has not yet been recorded and that the owner’s intent is to rearrange the parcel to create six lots from four; staff said each resulting lot would meet road-frontage and acreage requirements. The commission did not take a formal vote; the matter was discussed as a staff-level interpretation of the setback requirement and staff said it will proceed accordingly.
