Council members said the work is tied to an investigation of an adjoining parcel that has an underground oil tank and potential contamination. The owner and her insurer have negotiated access and agreed to indemnify the city and reimburse costs related to the investigation and any protective measures. City staff described the access as temporary and intended to facilitate remediation of the contaminated parcel.
The council voted in favor; supporters said approving the access and indemnification protects the city's liability while allowing environmental testing to proceed. Council members and staff said the work would result in some temporary parking disruption at the municipal lot and that the city would try to minimize inconvenience for tenants who use the lot; city staff indicated that work was expected to begin within weeks and could last 30 to 60 days after property access is granted.
The resolution authorizes execution of the limited access agreement and related indemnities. The city will require proof of insurance, an indemnity and reimbursement terms prior to allowing access for sampling. Council members said the action will help move remediation forward while protecting municipal interests.
