Lapeer commissioners postpone Clover School lease, allow tenant to repair roof with insurance

The Lapeer City Commission voted to postpone final approval of a proposed lease with the Clover School group and allowed the group's volunteers to begin replacing the school's deteriorating roof so long as they provide the city with insurance and building permits.
The decision came after John Creek, who identified himself as representing the Clover School group, told the commission the building's roof is in “very poor condition” and that the group has funds and a licensed contractor ready to begin work. The commission moved, by Commissioner Petrie and seconded by Commissioner Brady, to place the lease on the Nov. 3 agenda and to permit the tenant to start roof replacement in the interim if the group files insurance and required permits with the city (motion carried).
The commission's discussion emphasized the city's legal interest in the building and liability concerns. City Manager Womack and City Attorney Francis explained the group had been occupying the property on a month-to-month basis and that the draft lease would be a triple-net arrangement shifting maintenance responsibility to the tenant while the city retains ownership. Francis said he had no objection to allowing work to proceed if the contractor obtains required permits and extends insurance naming the city as appropriate.
Creek told commissioners the Clover School group has fundraised for the repair, has a licensed contractor (Stanford Home Improvement) lined up and is offering to perform the work at no cost to taxpayers. Commissioners asked staff to ensure the contractor obtains the building permits and that the city receive the group's insurance certificates before any work begins.
The motion sets the lease to return to the commission on Nov. 3 for formal consideration. In the meantime, staff will receive and review the contractor's permit application and insurance, and the group may proceed only after meeting those conditions.
Next steps: the lease will appear on the Nov. 3 agenda and staff will report back on the insurance and permit status before any work proceeds.
