The Kent County Regional Planning Commission on an October meeting date reviewed and recommended approvals for a series of land-use applications, including a conditional use for a telecommunications tower, a proposed zoning-map amendment and multiple commercial site plans.
The commission recommended conditional approval for application C-25-02, a telecommunications tower proposed outside the Growth Zone Overlay District. The commission’s recommendation cites the parcel’s AR (agricultural residential) zoning, which the staff report says permits a telecommunications tower as a conditional use, and requires compliance with staff and agency conditions. The recommendation also included a requirement that a red blinking safety light be installed at the top of the tower to “help ensure safety for low flying pilots,” as stated in the motion transcript. The commission vote was recorded as seven ayes in favor of recommending conditional approval.
The commission recommended conditional approval for application C-25-03, an auto wholesale/office use proposed outside the Growth Zone Overlay District on a parcel zoned AC (agricultural conservation). The motion and supporting findings reference the October 2, 2025 staff report and require the applicant to comply with staff and agency requirements and with Delaware Division of Motor Vehicles requirements; the approval explicitly prohibits on-site vehicle storage connected with the wholesale use. The vote was recorded as seven ayes in favor of recommending conditional approval.
The commission recommended approval of ordinance LC-25-22, a zoning-map amendment to reclassify a parcel (from RMH residential manufactured home and BG general business) to AC agricultural conservation and to amend the comprehensive-plan future-use map (from medium-density residential and highway commercial to low-density residential) inside the Growth Zone Overlay District. The motion referenced the October 2, 2025 staff recommendation and cited compatibility with surrounding mixed land uses. The recorded vote was seven ayes in favor of recommending approval.
The commission granted approval for several site-plan applications inside the Growth Zone Overlay District, based on staff reports dated October 9, 2025, and subject to standard conditions:
- Application S-25-08 (Sentinel Self Storage, LLC): approval of a site plan for a 2,616-square-foot office building (zoned BG, general business). Conditions cited include compliance with Chapters 187 and 205 of the Kent County code, meeting outside-agency requirements before final plan approval, final plan approval within 24 months of preliminary plan approval and commencement of construction within 18 months of final plan approval. Vote: seven ayes.
- Application S-25-10 (Mad Clay Homes, LLC): approval of a site plan for a 4,026-square-foot office building (zoned BG/GA per the motion transcription) with the same standard conditions and timing requirements noted above. Vote: seven ayes.
Across the meeting the commission approved the meeting agenda unanimously. The minutes for September 11, 2025 were put forward for approval; the clerk’s roll call recorded six yeas but the transcript records, “So you have 6 yeas. We're not voting in favor of approving the minutes of September 11,” indicating the minutes were not approved as presented.
Why it matters: The commission’s actions advance multiple development proposals through the county review process and refer a rezoning ordinance to the next step; the approvals impose standard timing and outside-agency compliance conditions that applicants must meet before final construction permits can be issued.

Details and conditions
Each site-plan approval and conditional-use recommendation cited the applicable sections of the Kent County code referenced in the staff reports and included the following recurring conditions: compliance with staff and outside-agency requirements before final plan approval; final plan approval to occur within 24 months of preliminary plan approval; and commencement of construction within 18 months of final plan approval. Several motions cited Chapters 187 and 205 of the Kent County code and Delaware subchapters (transcript references: 48‑02 and 48‑11) as the governing standards referenced in staff reports.
Next steps
Recommended conditional uses and the rezoning referral proceed to the county’s next procedural step (e.g., county council or other reviewing authority) per local process; site-plan approvals remain subject to the listed timing and outside-agency conditions before building permits or construction may begin.
Commission comments and public comment were minimal; the meeting concluded with a motion to adjourn.
