The Rutherford County Board of Zoning Appeals approved a special exception allowing an accessory structure to remain on a property at 7428 Midland Road before the construction of a principal dwelling.
Planning staff told the board the matter arose from a code‑enforcement referral. The structure is roughly 900 square feet with a lean‑to and is being used for personal storage and for equipment related to a small goat herd and a personal garden. Staff said the applicant, Tracy Duncan, has provided a written explanation and intends to construct a residence on the property in the future, although there is no immediate timetable.
Duncan told the board she cares for two goats and uses the structure to store feed, tools and garden materials; she said she is retired and cannot yet afford to build a house. Board members discussed the code‑enforcement origin of the case and examined photographs and the applicant’s property sketch illustrating the shed location, driveway and future home site.
Following a public hearing with no opposition, a motion to approve the special exception carried on a unanimous roll call: Mike Curtis — yes; Jerry Sartain — yes; Gary Farley — yes; Renee Curtis — yes; Patrick Hale — yes; Zane Cantrell — yes. The board’s approval allows Duncan to retain the storage building; construction of a future residence will require separate permitting and compliance with county building and zoning rules.
