Civil Service Commission tables rules changes on cross-county score acceptance and alcohol-related disqualification language

BERKELEY COUNTY, W.Va. — The Berkeley County Civil Service Commission on Oct. 15 again tabled proposed amendments to its rules and regulations that would (1) clarify whether test scores from other counties may be accepted for promotions and (2) revise preliminary requirements language addressing substance use and disqualifying alcohol behaviors.

The commission deferred both items to allow further legal and procedural review. For item 20250036, commissioners reiterated last month’s understanding that promotion eligibility requires two years in rank "in Berkeley County," and they tasked a commissioner to investigate statutory limits and reconcile county rules with that requirement. Commissioners agreed to table the promotional portion of 20250036 until the next meeting.

On item 20250038, which would change section 4 (preliminary requirements) to clarify disqualification language, commissioners described a contradiction between a broad requirement to be "clean and sober" and a separate clause that references "excessive alcohol use" as disqualifying. Commissioners said the language needs to be cleaned up before adoption and moved to table the item for additional drafting and review.

Commissioners explicitly left the substance of the proposals unchanged while asking counsel and the designated commissioner to provide a clarified redraft for the next meeting. The motions to table were seconded and carried by voice votes.

The commission’s minutes show these rules items were discussed at prior meetings; commissioners said they prefer concise, unambiguous wording that aligns with the Berkeley County Civil Service Commission’s existing Rules and Regulations and with applicable state law.

Because the matters relate to promotion eligibility and candidate screening, the commission described them as procedural priorities for ensuring fair hiring and internal consistency before adoption.
