BERKELEY COUNTY, W.Va. — The Berkeley County Civil Service Commission on Oct. 15 approved a revised waiver and release of liability intended for deputy sheriff applicants taking the department’s physical-agility test.
The commission’s action adopts a version of the waiver that merges counsel comments and the county legal director’s input and places the form into the commission’s candidate packet so it can be used for upcoming entry-level testing.
The change follows review by county legal counsel and a reduction to the legal retainer previously paid: a statement from counsel reflected a $100 deduction from an earlier retainer, leaving a remaining professional-services balance of $400, according to the commission’s financial summary.
Commissioners moved to accept the waiver as presented and then voted by voice for approval. The commission also agreed to keep the notary clause in the document "as it is" for use with applicants.
Commissioners did not add further modifications on the floor; the commission recorded the item as approved and moved to the next agenda matter.
The decision clears a procedural obstacle for candidates who must sign a release to participate in the physical-agility portion of the hiring process. The commission’s action applies only to the waiver form and does not itself alter testing standards or the physical-agility protocol.
The commission’s next regular meeting was scheduled for Nov. 19 at 5 p.m. in the commission chambers.
