Commission continues lot‑split review for Enclave at 8282 Lakeview Drive, requests court case and analysis

The Macedonia Planning Commission voted to continue consideration of a proposed lot split for the Enclave at 8282 Lakeview Drive to its November meeting after staff and commissioners found critical materials missing and the applicant was not present.

Staff said the filing lacked the documentation the commission had requested, most notably a referenced common-pleas court case that could affect allowable density or open‑space calculations. A staff member noted the court record is public but that it is the applicant’s responsibility to provide the case and a short analysis explaining why the proposed lot split does or does not affect standards established by that case.

Commissioners expressed concern that removing acreage from the plat could change overall density and open-space calculations tied to prior approvals. One commissioner said the record showed a notation that the parcel would be conveyed to a contiguous owner and remain vacant, but staff said the commission needed the court documents and an applicant analysis before acting. Commissioners moved to continue the item to the November meeting and asked that the applicant attend and submit the requested materials; the motion passed on a voice vote.

If the applicant fails to appear at the next meeting, a commissioner suggested the commission could place the item on an active agenda for denial for cause or otherwise act on the record.
