The city attorney informed the commission on Oct. 23 that two neighboring property owners filed a petition in circuit court challenging the commission’s approval of site-plan waivers for the Huddle 44 commercial project (Resolution 25-55).
Staff explained the petition asks the court to review the commission’s decision and alleges the city did not comply with certain portions of the land-development code; the petition does not allege monetary damages but seeks judicial review of the administrative decision. The court issued an order to show cause and the city will have 30 days to file a written response; staff also must prepare a certified record for the court’s review.
The city attorney said the city will coordinate the response and advised commissioners that, because litigation is pending, any substantive legal-strategy discussions could be held in closed session if the commission chooses. Staff confirmed they will prepare pleadings and the certified administrative record for the circuit court timeline.
The filing does not automatically stay the project approvals; the petition is a judicial review step and the city will respond through the prescribed appellate/court procedures.
