The Waupaca Common Council on Oct. 7 approved a memorandum of understanding (MOU) with the Waupaca Arts Hub to permit coordinated snow removal of the Arts Hub parking area, with the Hub performing removal and the city providing salting assistance and shared access to the driveway.
City staff said the arrangement covers only the parking lot (not sidewalks) and will provide public works support for salting as needed; it also preserves the city’s ability to use the adjacent parking lot for municipal access. During council discussion, a member asked where liability would lie for slip-and-fall incidents; staff pointed to the MOU language that requires the Waupaca Arts Hub to hold the city harmless for slips or falls (section 3.0, 3.a of the draft MOU).
Motion to approve the MOU was made by Mayo and seconded by Peterson and passed by voice vote. Council recorded the item as approved without objection.
Ending: With liability language included, staff said the MOU would allow the Arts Hub to maintain its parking area while enabling the city to coordinate access and limited salting support when required.
