Council approves lot replat for Hen House addition; existing nonconforming structures noted

The Beatrice City Council approved two related ordinances to vacate existing lot lines and approve the Hen House Addition plat, enabling three houses on two existing parcels to be divided into three separate lots for sale. The ordinances were approved by unanimous vote, 8–0.
Staff said the two subject lots, owned by Hen House LLC, contain three houses constructed circa 1915–1920 that do not conform to current setback rules; several accessory structures (garages or sheds) encroach across lot lines. The replat explicitly notes the nonconforming conditions so future buyers will be aware that rebuilding would require meeting current setbacks and standards.
The council first voted to vacate the existing lot configuration and then approved the plat (Ordinance No. 25-35). Staff said the replat will allow each house to be sold on its own legal lot while retaining disclosure of the existing encroachments; the council was told similar nonconforming situations exist in other parts of town.
Both ordinances were moved and passed under the council’s suspension of rules process and will be recorded according to standard platting procedures.
