Staff said the stormwater program — a cooperative education effort required under the town’s MS4 clean water permit — had suggested broader homeowner responsibility than the town’s existing practice. Town staff clarified at the council meeting that HOAs remain responsible for routine pond care (mowing, trash removal and avoiding chemical contamination), while the town stormwater utility remains responsible for infrastructure maintenance and repairs covered by the utility.
Town staff said several neighborhoods contacted council members and staff after the meeting and that the town has reached out to the county to request corrections and an explanation. Staff asked council members to direct residents who call about the issue to town staff for clarifications and said the town will work with Hendricks County to resolve the misinformation.
No formal action was taken; staff said they would coordinate with the county and provide updated guidance to HOAs.
