Staff said Oroville’s current code distinguishes maintenance by property ownership — public right-of-way features are city responsibilities while items on private property remain the property owner’s duty — but that the code lacks explicit language about driveway culverts. Staff proposed three options: (1) make culverts the property owner’s responsibility; (2) keep owner responsibility but add city inspection/notification and possible financial assistance through existing programs; or (3) have the city assume ownership, inspection and maintenance (with attendant cost and gift-of-public-funds risk).
Council discussion leaned toward making driveway culverts the property owner’s responsibility with staff drafting clear definitional language and enforcement/notification processes. Council also asked staff to study potential assistance options, such as owner-occupied rehab loans, to help qualifying residents with replacement or repair costs.
Staff said they would return with proposed ordinance language and options for a potential loan or grant program to help eligible property owners.
