Two Buellton residents addressed the council during the public comment and consent calendar period on Oct. 25, raising related concerns about property corner markers and an incomplete drainage system tied to Zaca Creek.
Nancy Dorwin, a Rancho de Maria resident, said sidewalk work associated with Frontier Communications’ fiber-optic installation in August removed two front-corner property survey markers for her lot and that the markers were not reset or recorded with the county. She told council staff she had contacted a city inspector and requested that a licensed land surveyor be engaged to reset the markers and record the locations with the county. ‘‘We want to make sure that what follows is according to the state requirements and the county surveyor’s requirements, and those are recorded again with the county,’’ Dorwin said.
John Dorwin (same household) spoke during the consent calendar discussion to emphasize a broader drainage problem. He said the city’s stormwater plan for Zaca Creek lacks maintenance easements and facilities to move water from a homeowners association parcel to the San Ynez River, resulting in documented flooding, sedimentation and erosion on common-area parcels. He said those conditions prompted a pending court filing (a second amended complaint alleging declaratory relief and writ of mandate) and argued the annual stormwater management plan filing should note the defect rather than be filed unchanged.
A staff response on the record noted that Zaca Creek is under the control of a county agency and has been since the city’s incorporation, and therefore staff said it is not included in the city’s stormwater system or program. ‘‘The report can be filed, as it's been every year,’’ a staff member said during the meeting.
After the public comments and staff response, the council proceeded with the consent calendar; the consent calendar (which included the SWMP annual report filing and other administrative items) was approved unanimously.
Dorwin said she has asked the city for a copy of any encroachment permit and pressed for a timely inspection and a licensed surveyor to reset and record missing markers. Councilmembers directed staff to note the concerns and, where appropriate, coordinate with county agencies and the homeowners association to assess maintenance and easement needs.
