BZA extends order and approves modification for Solid Brick Ventures redevelopment with conditions from OAG

The Board of Zoning Adjustment on Oct. 15 approved a two-year extension and a modification to a prior order for Solid Brick Ventures’ multi-building redevelopment on Hawaii Avenue NE, allowing certain changes to unit counts and penthouse dimensions while preserving affordable-housing obligations from a prior settlement.
The board approved application No. 20507C, a request under Subtitle Y §705.2 (time extension) and Subtitle Y §704 (modification with hearing), and a special exception under Subtitle U §421 for adding residential units. The approved time extension will run through May 24, 2027, the board said.
Alex Wilson, counsel for the applicant, said the modification applies to six properties in the original Hawaii-Webster complex and would keep the building envelopes approved in BZA Case 20507 while changing unit mixes to add units in cellar and a new third floor without increasing the approved building envelope. Wilson said each building will meet inclusionary zoning requirements and comply with an affordable-housing covenant and Office of the Attorney General settlement conditions.
Christopher Peña of the Office of the Attorney General’s Housing and Environmental Justice team said OAG is neither in favor nor opposed but asked the board to reflect in any order the applicant’s separate legal obligations arising from a 2022 consent order and a recorded 25-year affordable housing covenant. Peña said the covenant requires existing rent-stabilized units remain subject to rent-control and noted a typographical error in OAG’s submission clarifying a property reference.
Chairman Fred Hill and Vice Chair Carl Blake said they would include a note in the order referencing OAG’s letter and the applicant’s commitments regarding trash and rodent control during construction; the applicant confirmed daily trash removal and a rodent-control plan. The Office of Planning recommended approval of the modification and extension in its report. ANC 5A voted in support of the modification, and the applicant said it had met with neighbors and community stakeholders about construction and trash removal.
The motion to approve was made by Chair Hill and seconded by Vice Chair Blake; staff recorded the vote as 3–0–2 to approve application 20507C.
