Council approves city attorney report and draft ordinance tied to digital-signage settlement

City Attorney staff presented a report and draft ordinance to implement terms of a settlement related to the municipal code’s definitions for digital signs. The City Attorney told council members that the ordinance is part of the settlement and that if the council does not adopt the ordinance the parties would return to litigation.
“prácticamente, esto es un compromiso en el arreglo, si la ordenanza no está aprobada, entonces, el arreglo ya no va a existir, va a ser no limitado, y y las partes van a continuar en los litigios, en los reclamos,” the City Attorney said while explaining the implications of adoption.
Councilmembers asked whether approving the ordinance would require further city actions; the City Attorney said the draft ordinance would implement the settlement’s terms and would not itself change unrelated city code steps beyond those required by the agreement. After discussion the council voted to approve the city attorney’s report and the draft ordinance; affirmative votes were recorded for Councilmember Hernández, Councilmember Padilla and Councilmember Hart.
The report on the desk tied the draft ordinance to a previously negotiated settlement; staff did not discuss the settlement’s monetary terms in the public presentation. Councilmembers did not record further amendments on the floor. The council also scheduled a closed-session item later in the agenda related to separate litigation.
