County staff said the bids were opened on Sept. 10 and that a solicitation‑phase error compromised fairness by excluding a qualified vendor. The presenter cited Local Government Code 262.027(f) as the legal basis allowing the commissioners court to reject any and all bids before award when the solicitation process was flawed.
Commissioners asked whether a delay in awarding the contract would result in a lapse of pricing. Staff responded that the current pricing would remain in effect until the county receives and accepts new bids. One commissioner sought confirmation, and staff answered, “My understanding is yes. Until we get the new bids in and accept it.”
The court made a motion, seconded, and approved rejection of the bids and re‑solicitation by voice vote. County purchasing staff were authorized to reissue the solicitation and ensure all eligible vendors are included.
