Committee introduces RS31929 to allow annexation and administrative fixes for Eastern Snake River Plain groundwater districts

Representative Mickelson (Legislative District 32) told the House Resources and Conservation Committee that RS31929 makes technical corrections to statutes implementing last year’s groundwater reorganization and would permit smaller subbasins to join existing groundwater districts.
The proposal would allow a basin or subbasin to annex into an existing groundwater district and would allow additional board members to be added so newly annexed areas can have representation, Mickelson said. She also said the draft changes move some statutory billing and delinquency dates to timelines that are workable in practice and add explicit authority to use telemetry to measure water use rather than relying only on traditional, stationary water meters.
“On page 1, it simply gives us the ability to annex those groundwater districts into an existing district and if so, it allows us to add additional board members,” Mickelson said. She told the committee groundwater areas may either form their own district or join an existing district under prior law and RS31929 fills gaps that emerged when many subbasins were required to organize.
Representative Raybould moved to introduce RS31929; the motion carried on a voice vote and the RS will be formally introduced for the legislative process.
Members asked for clarifications about the mechanics of annexation. Representative Miller asked whether a district may subdivide itself; Mickelson said the bill does not allow a district to divide into new districts, only the limited scenarios of forming a new district or annexing into an existing district. Mickelson also described practical problems with the prior billing timeline (assessments mailed December 1 with delinquency entries in January were too tight) and said telemetry can provide more timely and less costly measurement for many irrigators than the expensive mechanical meters now in use.
The committee did not take final substantive action on governance or funding beyond introduction; RS31929 was introduced for further consideration in the legislative process.
