Committee approves nursing‑home administrator rule rewrite; board to seek fee adjustments later

The Idaho House Health and Welfare Committee on Jan. 22 approved pending administrative rules from the Idaho Board of Examiners of Nursing Home Administrators (docket 24‑0901‑2401), voting to finalize a comprehensive rewrite of the chapter that reorganizes licensure material, removes language duplicative of statute and reduces continuing‑education burdens.
Cecily Metcalfe, Board Services Program Manager for the Division of Occupational and Professional Licenses and executive officer for the nursing‑home board, presented the rewrite. The clean‑version chapter reorganizes material into legal authority, scope, licensure and fees and removes provisions determined to be examination provider responsibilities (examination dates, passing scores, content). The board added a licensure pathway for holders of a health services executive credential, allowed approval of continuing education courses by entities not explicitly listed in the rule and reduced continuing‑education hours to align with the state’s shift to biennial renewals.
Metcalfe told the committee the board’s cash balance was negative $7,128.78 as of Sept. 30 and that staff expect to pursue negotiated rulemaking during the coming year to adjust fees so the board complies with statutory cash‑balance targets. "We are looking at more than likely going through negotiated rulemaking over the next year to address the fees," Metcalfe said.
Representative Healy made the motion to approve docket 24‑0901‑2401; with no discussion the committee approved the docket by voice vote. The committee chair noted there are similarly numbered dockets for other boards and asked presenters to be explicit when identifying dockets during session.
Why it matters: The rule rewrite removes provisions that were duplicative of statute, clarifies trainee and preceptor requirements, creates an additional licensure pathway and aligns continuing education and renewal cycles to reduce regulatory burden for licensees. The board’s reported negative cash balance signals it will return to the committee if fee changes are pursued through negotiated rulemaking.
No amendments were made to the draft during committee consideration; the committee recorded an approving voice vote and the docket will proceed to the concurrent chamber’s review as part of the state rule process.
