Panel approves introduction to move Department of Labor rules into statute for readability

Representative Laurie McCann presented RS 31,830 to incorporate multiple Idaho Department of Labor IDAPA rules into statute, a response to 2024 legislation directing agencies to review rules for possible codification.
McCann said the proposal would move roughly 32 pages of existing administrative rules into new and amended statutory sections within Title 72 (Employment Security Law) and Title 45 (claims for wages). The move aims to consolidate requirements in one place to avoid back-and-forth between statute and rule, she said. McCann cited IDAPA dockets the department is reworking, including IDAPA 90.101 (rules of administrative procedure), IDAPA 90.108 (disclosure of employment security information), and IDAPA 90.130 (unemployment insurance benefits administration rules), and said much of the language is being carried into statutes without substantive policy change.
The committee voted to introduce RS 31,830; the motion passed.
