Committee considers updates to Idaho Code of Military Justice for National Guard misconduct process

Representative Ted Hill (District 14) gave a brief introduction to RS 31809 and asked Captain Derek Anderson of the Idaho National Guard to outline proposed updates to the Idaho Code of Military Justice.

Captain Anderson said the changes are aimed at streamlining responses to minor misconduct by empowering lower-level commanders to impose administrative sanctions under Article 15 and by limiting enlisted members' ability to decline non-judicial punishment (NJP) and demand a court-martial for low-level offenses. He described the intent as restoring the role of lower-level commanders who are "actually with their soldiers more often and understand the needs of the unit and the wing." The bill would also add an appellate layer allowing service members to appeal sanctions up to the Adjutant General.

Anderson said the proposals would also change the current ability of senior enlisted leaders (E-7 and above) to refuse a summary court-martial and demand a higher-level forum, saying the current practice can cause lengthy delays for minor matters. He stressed the proposals are aimed at minor misconduct; felony-level or serious offenses would remain with civilian agencies and standard criminal proceedings.

When asked to provide an example of "minor misconduct," Anderson replied, "soldier shows up drunk. They're in formation and they're drunk. A soldier being disrespectful to a senior officer, not following order." The captain also said the bill includes technical updates to align Article 7 with the 2018 State v. Clark decision and removes obsolete references (midshipmen, Coast Guard) that do not apply to Idaho.

Representative Nicholson moved to introduce RS 31809; the committee voted in favor by voice vote and the measure was introduced.
