Judicial modernization bill amended to require physical reports, advances to Senate floor
Summary

The Senate Judiciary Committee approved two amendments and recommended Senate Bill 98 to the full Senate on Feb. 12 after a work session on the Oregon Judicial Department’s omnibus modernization bill.
Committee staff summarized SB 98 as a package of updates to court procedures and authorities, including expanded electronic communications for jury forms and filings, clarified contempt and administration provisions, family-law clarifications and an update on the publication of appellate decisions.
Sen. Thatcher moved the first amendment (dash 1), which made technical corrections to statutory references; the committee adopted it by roll-call.
A second amendment (dash 3) modified a provision about publishing appellate opinions. The introduced bill had proposed removing the requirement for paper or bound compilations of opinions; the dash 3 amendment instead requires at least one physical copy of advance reports or “advance sheets” to be maintained at the State of Oregon Law Library and at least one free physical copy to be held by each accredited law school in Oregon. Senator McLean pressed for a safeguard to preserve access to printed law in the event of extended outages; supporters said the amendment strikes a balance between modern publication practices and redundancy.
After adopting the amendments, the committee voted to report SB 98 to the floor with a due-pass recommendation. The committee recorded roll-call votes for the two amendment adoptions and for the due-pass recommendation; each recorded vote was unanimous among senators present at the time of the roll calls. The bill was assigned a floor carrier and sent to the Senate calendar for further consideration.
The committee closed the work session and adjourned until the next scheduled meeting.
